Terms of Service

These Terms of Service (“Terms”) govern your access to and use of VistaRight (the “Service”), a service operated from the United Kingdom. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account, the security of your credentials, and all activity under your account.

2. Subscriptions & Billing

• Paid plans are billed in advance on a monthly or annual basis through Stripe.
• Subscriptions renew automatically until cancelled.
• Except where required by law, fees are non-refundable.
• We may change pricing with reasonable notice; changes apply at the next renewal.

3. Acceptable Use

You agree not to:

• Violate any law or third-party rights, including intellectual property and privacy rights.
• Upload content that is illegal, infringing, harmful, or that you do not have rights to use.
• Attempt to reverse engineer, scrape, or interfere with the Service or its infrastructure.
• Use the Service to build a competing product or to train competing AI models.

4. Your Content

You retain ownership of content you upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display Your Content solely as needed to provide and improve the Service. You represent that you have all necessary rights to Your Content.

5. AI Outputs

The Service uses AI models to generate outputs from your inputs. Outputs may be inaccurate or unsuitable for your intended use. You are responsible for reviewing outputs before relying on or publishing them.

6. Intellectual Property

The Service, including all software, design, and trademarks, is owned by VistaRight and its licensors. No rights are granted except as expressly stated in these Terms.

7. Termination

You may cancel at any time from your account settings. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISTARIGHT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR £100, WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to defend and indemnify VistaRight from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your breach of these Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the jurisdiction of the courts of England and Wales, unless applicable law gives you the right to bring proceedings elsewhere.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use after changes constitutes acceptance.
